When the holder dies, the box closes: what Belgian law organises next
Local edition · Tournai, Picardy Wallonia
What actually happens when the holder dies?
The bank freezes the box as soon as it learns of the death, just as it freezes the accounts; access is only reopened for the inventory required by law, then for the handover of the contents to the beneficiaries.
The mechanism is identical throughout Belgium. Once informed of the death, the bank freezes everything: personal accounts, joint accounts and any box rented by the deceased, their spouse or held jointly. No one can open the box anymore, not even an heir holding the key. Banking institutions must report the deceased's assets as of the day of death to the tax administration, and it is as a precaution for this obligation that they freeze accounts and boxes (belgium.be, in French).
The opening is then supervised by article 101 of the Inheritance Tax Code: no safe deposit box rented from a professional may be opened after the death except in the presence of the lessor, who must draw up and hand to the competent official, before any taking of possession, a sincere and true list of everything the box contains (official text, in French). The heirs are summoned to the opening and the inventory; the contents then join the estate declaration, before any distribution.
And when relatives do not know where the deceased was a customer? The notary can rely on Febelfin's Bankresearch service, which searches accounts and boxes across its member banks (febelfin.be).
Why is the box frozen?
Article 4.48 of the Civil Code treats concealment or a false statement made in bad faith for an advantage over co-heirs or estate creditors as concealment of estate assets: the heir or successor thus sanctioned is deprived of the right to renounce and remains an unconditional heir, with no claim to any share in the concealed assets (article 4.48 of the Civil Code, in French). In other words, removing an object from a deceased person's box before the inventory, however small its value, may be treated as estate concealment: speak to the notary before any access.
What should you do if you hold the box key?
Even with the key and the code, relatives must not open the box on their own initiative.
The surviving spouse is in no different position: banks freeze assets in the name of the deceased, of their spouse and those held jointly (notaire.be, in French).
Is a private box outside a bank frozen in the same way?
The succession rules are identical; only the practical organisation of access differs.
Article 101 of the Inheritance Tax Code does not only target banks: it applies to any person or company habitually renting out safe deposit boxes, which includes private vaults such as the one run by Gold & Silver Company in Dottignies (Mouscron). There too, opening after a death requires the presence of the lessor and the drawing up of the contents list, and the contents join the estate declaration like any other asset.
The conduct remains the same as with a bank: inform the notary and the lessor, take nothing out.
How long does the box stay frozen?
The time needed to identify the heirs and complete the inventory, each file having its own pace.
Unfreezing follows the production of a deed of inheritance drawn up by the notary or a certificate of inheritance issued by the Bureau Sécurité juridique; for the latter, notaire.be describes the wait as "the weeks that follow" the request (notaire.be, in French). The opening of the box is then scheduled in the presence of the heirs, who sign the inventory. A will, a joint box, heirs abroad or a disputed succession can extend the timeline: only the notarial office in charge of the file can give a reliable date.
And during joint heirship, where should the valuables be kept pending distribution?
With a neutral depositary accepted by all the heirs.
The lot is then inventoried adversarially, photographed, weighed and described piece by piece, then sealed; a convention signed by all the co-heirs forbids any handing over or opening without everyone's agreement, except by court decision.
Your questions about boxes frozen on death
Can the bank refuse access to the box even with the deceased's key?
Yes, and that is the rule. As soon as the bank learns of the death, it freezes access to the box, exactly as it freezes the deceased's accounts. The key, the code or an old power of attorney no longer open anything: only the succession procedure will reopen the door, in the presence of the lessor, for the inventory required by article 101 of the Inheritance Tax Code.
Can the surviving spouse still open the joint box after the death?
In practice, no, not freely. Banks freeze accounts and boxes in the name of the deceased, of their spouse and those held jointly, whatever the matrimonial regime. Even as a co-holder, the survivor must go through the procedure: inform the notary, obtain the deed or certificate of inheritance, then a supervised opening with inventory.
What do you risk by emptying a parent's box before the inventory?
A finding of estate concealment, if bad faith and an intent to gain an advantage at the expense of co-heirs or creditors are established. Article 4.48 of the Civil Code punishes the heir who, in bad faith, conceals estate assets: deprived of the right to renounce, they remain an unconditional heir, debts included, with no claim to any share in the concealed assets. The rule of conduct: do not open the box on your own initiative; report its existence to the notary and the lessor, who will together arrange the inventory required by article 101 of the Inheritance Tax Code.
Are the accounts and the box frozen at the same time?
Yes, generally upon the same notification. Once informed of the death, the bank freezes all assets: current accounts, savings accounts, securities accounts and the box, in the name of the deceased as well as their spouse and jointly held. A few operations remain possible on accounts, such as the direct payment of certain funeral bills considered priority, but the box stays shut until the inventory. The assets are reported to the tax administration, which will check the estate declaration.
How do you find out whether a deceased person rented a box in Belgium?
Start with the notary: they can ask the banks where the deceased was a customer and check whether a box rental existed. Relatives can also write to the succession departments of known banks, or rely on Febelfin's Bankresearch service, presented earlier in this report. Physical clues help: a box key, rent receipts, a rental contract.
How do you keep succession valuables safe during joint heirship?
The lot is then inventoried adversarially, photographed, weighed and described piece by piece, then sealed; a convention signed by all the co-heirs forbids any handing over or opening without everyone's agreement, except by court decision. No heir can therefore access the lot alone, and the inventory drawn up at deposit then serves both the notary and the distribution.
